I just checked the United States Patent and Trademark Office database
and it appears that Maytag no longer owns the trademark and it expired
on January 22, 2005. The Iowa Interstate is currently and applicant
for ownership, but there is no indication of actually ownership yet.
The USPTO published the IAIS application in June of this year for
anyone to oppose to their application.
I am not sure of is whether or not permission would still be needed to
use the herald (logo) from an applicant vs. an owner or registrant.
Additionally it appears that the IAIS only applied for the trademark
ONLY as it applies to model and/or trains (similar to Maytag's former
ownership of the logo). Lionel Toys has filed an opposition to the
IAIS application as recent as October, 2007. There appear to be no
other "live" files in the USPTO database that indicate anyone owns the
rights to the Rock Island herald or logo.
Here's a link to the USPTO web page regarding the IAIS application:
http://tess2.uspto.gov/bin/showfield?f=doc&state=60lb2s.3.1
So it appears their at this time there is no registrant that owns the
trademark of the Red and White Rock Island Herald. I am not a patent
attorney and cannot absolutely verify this, but this is what I found.
I hope this helps!
Tom
